1. Introduction
1.1
This Privacy Policy (“Privacy Policy”) explains how the Provider collects, uses, processes, stores, discloses, transfers, and protects information relating to individuals who access or use the Platform, website, software, Services, or any other products or features made available by the Provider.
1.2
This Privacy Policy forms an integral part of the legal documents governing the use of the Platform and shall be read and interpreted together with the Terms of Service.
1.3
By registering an account, purchasing a Subscription, accessing, or using the Platform or the Services, the Subscriber acknowledges that it has read, understood, and agreed to this Privacy Policy.
1.4
The Provider is committed to processing Personal Information in accordance with applicable laws and regulations and in compliance with the principles of confidentiality, proportionality, security, and lawful processing.
2. Scope of this Privacy Policy
2.1
This Privacy Policy applies to all Personal Information and other information collected or processed by the Provider in connection with the Platform and the Services.
2.2
This Privacy Policy applies only to information collected or processed by or on behalf of the Provider and does not apply to any websites, platforms, applications, or services operated by third parties that may be accessible through or integrated with the Platform.
2.3
The use of third-party websites or services is governed by the respective terms and privacy policies of those third parties, and the Provider accepts no responsibility or liability for their privacy practices or data processing activities.
3. Information We Collect
3.1
The Provider may collect and process information that the Subscriber voluntarily provides when registering an account, purchasing a Subscription, using the Services, or communicating with the Provider.
3.2
Depending on the nature of the Services, such information may include:
• Full name
• Business name or trade name
• Company name
• Telephone number
• Email address
• Country or place of business
• User Account information
• Subscription information
• Billing information
• Payment records (excluding complete payment card details)
• Information provided through support requests or other communications
3.3
The Platform may also automatically collect certain technical and operational information, including:
• IP address
• Browser type and version
• Device type
• Operating system
• Device identifiers
• Date and time of access
• Pages or features accessed
• Error logs
• Platform performance and security information
3.4
The Provider may use aggregated, anonymized, or de-identified information relating to the use of the Platform for statistical analysis, service improvement, feature development, security enhancement, performance optimization, and other legitimate business purposes.
3.5
Where the Subscriber uploads, stores, or otherwise processes information relating to its employees, representatives, customers, or any other third parties through the Platform, the Subscriber is solely responsible for obtaining all required consents, permissions, and legal authorizations necessary for such processing.
4. Legal Basis for Processing
4.1
The Provider processes Personal Information only to the extent necessary for providing the Services, performing contractual obligations, administering User Accounts, processing payments, providing customer support, maintaining Platform security, preventing fraud, complying with legal obligations, and pursuing other legitimate business interests.
4.2
The Provider will not process Personal Information for purposes that are inconsistent with this Privacy Policy unless the Subscriber has provided consent or such processing is otherwise permitted or required by applicable law.
5. Use and Processing of Information
5.1
The Provider shall process information solely to the extent necessary for providing, administering, supporting, maintaining, developing, and improving the Platform and the Services.
5.2
Depending on the nature of the Services, the collected information may be used for the following purposes:
• Creating, managing, and authenticating User Accounts;
• Providing the Platform and the Services;
• Processing Subscriptions, payments, and billing;
• Providing customer support and responding to inquiries;
• Sending service-related notices, alerts, and communications;
• Enhancing Platform security and preventing fraud, abuse, or unauthorized access;
• Developing, testing, improving, and optimizing the Platform and the Services;
• Analyzing Platform performance and preparing statistical reports;
• Complying with applicable laws, regulatory requirements, and lawful requests from competent authorities.
5.3
The Provider shall not sell, rent, or otherwise use the Subscriber’s Personal Information for third-party marketing purposes or for any purpose inconsistent with this Privacy Policy, unless the Subscriber has expressly consented or such processing is permitted or required by applicable law.
6. Provider’s Role in Data Processing
6.1
Where the Subscriber uploads, stores, or otherwise processes information relating to its customers, employees, representatives, or other persons through the Platform, the Subscriber shall remain solely responsible for the lawful collection of such information and for determining the purposes and means of its processing.
6.2
In such circumstances, the Provider shall process such information solely for the purpose of providing the Services and in accordance with the Subscriber’s instructions, except where processing is required by applicable law or by a lawful order issued by a competent authority.
6.3
The Provider does not claim any ownership rights over data belonging to the Subscriber or its end users. Such information shall be processed solely to provide the Services, perform contractual obligations, maintain Platform security, and comply with applicable legal requirements.
7. Sharing and Disclosure of Information
7.1
The Provider does not sell the Subscriber’s Personal Information and will not disclose such information to third parties except as described in this Privacy Policy or as required or permitted by applicable law.
7.2
The Provider may share information, only to the extent necessary, with service providers assisting in the operation and delivery of the Platform and the Services, including payment service providers, cloud hosting providers, infrastructure providers, email service providers, SMS providers, technical support providers, and other similar service providers, provided that such parties are contractually obligated to maintain appropriate confidentiality and data protection standards.
7.3
The Provider may disclose information where required by applicable law, a court order, or a lawful request issued by a competent governmental or regulatory authority.
7.4
In the event of a merger, acquisition, business transfer, sale of assets, corporate restructuring, or any other lawful transfer of all or part of the Provider’s business or operations, relevant information may be transferred to the legal successor or transferee, provided that such successor remains subject to confidentiality obligations and applicable data protection requirements.
8. Information Security
8.1
The Provider implements reasonable technical, organizational, and administrative safeguards designed to protect information against unauthorized access, unlawful use, disclosure, alteration, loss, destruction, or other unauthorized processing.
8.2
Such safeguards may include, where appropriate, access controls, authentication mechanisms, encryption, security event logging, backup procedures, security monitoring, and other generally accepted information security measures.
8.3
While the Provider employs appropriate security measures, no system, network, or method of transmitting or storing information over the Internet can be guaranteed to be completely secure. Accordingly, the Provider does not warrant or guarantee the absolute security of any information.
8.4
The Subscriber is responsible for maintaining the confidentiality of its Account credentials, passwords, and other authentication information and shall remain responsible for all activities conducted through its Account unless unauthorized access results from the Provider’s breach of its legal obligations.
9. Data Retention and Deletion
9.1
The Provider retains Personal Information only for as long as necessary to provide the Services, perform contractual obligations, comply with applicable legal requirements, resolve disputes, enforce legal rights, or satisfy other legitimate business purposes.
9.2
Following the termination of a Subscription or the deletion of an Account, the Provider may retain certain information for a reasonable period where necessary to comply with legal obligations, resolve disputes, prevent fraud, protect legal rights, or otherwise as permitted or required by applicable law.
9.3
Upon expiration of the applicable retention period, the Provider shall delete, anonymize, or irreversibly de-identify the relevant information unless a longer retention period is required by applicable law.
10. Subscriber Rights
10.1
Subject to applicable law, the Subscriber may request access to, correction of, or updating of its Personal Information.
10.2
Where permitted by applicable law, the Subscriber may request the deletion of, or restriction on the processing of, its Personal Information, provided that complying with such request does not prevent the Provider from fulfilling its legal or contractual obligations.
10.3
Where the processing of Personal Information is based on the Subscriber’s consent, the Subscriber may withdraw such consent at any time with future effect, subject to applicable law. Withdrawal of consent shall not affect the lawfulness of any processing carried out prior to such withdrawal.
10.4
The Provider shall consider and respond to requests relating to the rights described in this Section within a reasonable period and in accordance with applicable law.
11. Cookies and Similar Technologies
11.1
The Platform may use cookies, pixels, local storage, and other similar technologies to enhance security, maintain user sessions, provide technical functionality, analyze the use of the Platform, improve the Services, and enhance the overall user experience.
11.2
The Subscriber may manage, restrict, or disable certain cookies through the settings of its browser or device. However, disabling certain cookies or similar technologies may affect the functionality, performance, or availability of certain features of the Platform.
11.3
Where the Platform utilizes analytics tools or other technologies provided by third parties, the collection and processing of information through such tools may also be subject to the respective privacy policies and terms of those third parties.
12. International Data Transfers
12.1
Personal Information may be stored, processed, or accessed on servers, systems, or data centers operated by the Provider or its authorized service providers, provided that appropriate technical, organizational, and security measures are maintained in accordance with applicable law.
12.2
Where it is necessary to transfer Personal Information outside the Subscriber’s country of residence or outside the Sultanate of Oman for the purpose of providing the Services, the Provider shall use commercially reasonable efforts to ensure that such transfers are carried out in accordance with applicable law and are subject to appropriate safeguards designed to protect Personal Information.
13. Changes to this Privacy Policy
13.1
The Provider reserves the right to amend, modify, supplement, or update this Privacy Policy at any time.
13.2
Any revised version of this Privacy Policy shall become effective upon its publication on the Platform unless a different effective date is expressly stated.
13.3
Where material changes are made to this Privacy Policy, the Provider shall use commercially reasonable efforts to notify Subscribers through the Platform, email, or other appropriate communication channels before or as soon as reasonably practicable after such changes become effective.
13.4
The Subscriber’s continued access to or use of the Platform or the Services after the effective date of the revised Privacy Policy shall constitute acceptance of the updated Privacy Policy.
14. Contact Information
14.1
If the Subscriber has any questions, requests, complaints, or wishes to exercise any rights relating to Personal Information or this Privacy Policy, the Subscriber may contact the Provider using the official contact details published on the Platform.
14.2
The Provider shall review and respond to requests relating to this Privacy Policy within a reasonable period and in accordance with applicable law.
